After first winning against Oculus, ZeniMax has filed a lawsuit against Samsung over its virtual reality technology. The case is based around the same claim that Oculus exec John Carmack worked on VR tech at ZeniMax and inappropriately took that work outside of the company.
In the case of Oculus, Carmack directly brought the tech to Oculus and therefore to Facebook. Samsung is being sued since Oculus powers the Gear VR.
Samsung is accused of pushing forward with its Gear VR development despite knowing about ZeniMax’s lawsuit against Oculus, which was filed during the mobile headset’s creation.
Samsung continued to develop the Gear VR with full knowledge of ZeniMax’s allegations and without obtaining any right or permission from ZeniMax to use any of its copyrights or other confidential information. – ZeniMax’s lawsuit
In the Oculus lawsuit, the company and its executives were penalized on copyright infringement, false designation, and NDA violation grounds.
Samsung must now defend itself against claims of copyright infringement, trade secret misappropriation, unfair competition, and unfair enrichment.
