Uber Argues Users Forfeit Right To Sue

Uber is arguing in a US appeals court that users give up their right to sue once they begin using the service. According to the company, accepting Uber’s terms and conditions means forfeiting the ability to file a lawsuit.

In this particular case, it believes a case regarding pricing practices should be sent to arbitration. The last judge reviewing the case, US District Judge Jed Rakoff, refused to make that order.

Uber’s Theodore Boutrous says it’s made clear to users that they’re agreeing to the terms and conditions upon signing up. A smartphone user “can’t miss” that notice.

On the opposing side is an argument that users cannot be expected to understand the full conditions upon registering.

Two members of the judge panel, Susan Carney and Reena Raggi, pointed out that making a payment through Uber goes beyond just registering.
